Terms of Service

These Terms of Service ("Terms") govern your use of the Emote Exchange Twitch Extension ("Emote Exchange", "we", "us", "the service"). By installing, configuring, or using the extension, you agree to these Terms. If you do not agree, do not use the extension.
Emote Exchange is operated by an independent developer based in the United States. Contact: support@emote.exchange.
1. What Emote Exchange is
Emote Exchange is a virtual stock-market mini-game inside a Twitch Extension. Viewers buy and sell virtual shares of a channel's emotes using a virtual balance. Prices move based on chat activity, trading volume, and Bits-activated effects. All currency, shares, balances, and points in the game are virtual, have no monetary value, are not redeemable for cash or any real-world item, and cannot be exchanged off-platform.
2. Eligibility
You must be at least 13 years old and meet Twitch's own age and eligibility requirements to use the extension. Broadcasters who install the extension must own or have authority over the Twitch channel where it is installed.
3. Your Twitch account
You are responsible for compliance with Twitch's Terms of Service and Community Guidelines when using the extension. We may rely on Twitch's authentication, identity, and Bits systems; we are not responsible for actions Twitch takes against your account.
4. Virtual items have no value
Without limiting anything else in these Terms:
- The in-game balance, holdings, transaction history, leaderboard rank, and any other in-game state are virtual and have no cash value.
- We may adjust, reset, revoke, freeze, or delete any virtual balance, holding, transaction, or game state at any time for any reason, including to fix bugs, address abuse, or shut down the service.
- We do not offer refunds of any virtual currency or in-game state.
- Bits used inside the extension are governed by Twitch's Bits Acceptable Use Policy and Twitch's terms — not by these Terms. Any refund of Bits is at Twitch's sole discretion.
5. Acceptable use
You agree not to:
- Exploit bugs, race conditions, or other unintended behavior to gain in-game advantage.
- Use bots, scripts, or other automation to interact with the extension.
- Reverse-engineer, decompile, or attempt to extract source code or game-tuning parameters from the extension or our backend.
- Use the extension to harass, threaten, dox, or otherwise harm another user.
- Operate multiple Twitch accounts to circumvent in-game limits or distort the leaderboard.
- Interfere with, overload, or attempt to bypass the security of our infrastructure.
- Use the extension for any unlawful purpose or in any way that violates Twitch's terms.
We may suspend or terminate your access to the extension if we reasonably believe you have violated any of the above.
6. Broadcaster responsibilities
If you install Emote Exchange on a channel you own:
- You agree to provide accurate channel information during setup and to maintain your eligibility to operate the channel on Twitch.
- You acknowledge that we read public chat messages, stream state events, subscription events, and Bits transactions in your channel via Twitch EventSub to run the game.
- You can disable the extension at any time via your Twitch dashboard. When you do, we follow the data retention rules described in our Privacy Policy.
- You are responsible for your own compliance with applicable tax, gambling, securities, or other laws in your jurisdiction — Emote Exchange is a game, not a financial product, and we make no representations about whether it is permitted in any specific jurisdiction.
7. Service availability
We provide the service on a best-effort, as-is basis. We may modify, suspend, or discontinue the service (in whole or in part) at any time without notice. We do not guarantee that the service will be available, uninterrupted, secure, error-free, or that any in-game state will be preserved across updates, outages, or migrations.
8. Intellectual property
Emote Exchange and the underlying code, design, and game mechanics are owned by us. We grant you a limited, non-exclusive, non-transferable, revocable license to use the extension solely as intended through the Twitch platform. Twitch emotes used inside the game remain the property of Twitch or the relevant broadcaster.
9. Third-party services
The extension relies on Twitch (for authentication, EventSub, Bits, and panel hosting) and Cloudflare (for edge networking). Your use of those services is governed by their own terms and policies. We are not responsible for outages, data handling, or other actions of those third parties.

11. Limitation of liability
Because all in-game items are virtual and have no cash value (see Section 4), the loss of any in-game balance, holding, or rank does not constitute compensable damage.
12. Indemnification
You agree to defend, indemnify, and hold harmless the operator of Emote Exchange from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the service in violation of these Terms; (b) your violation of Twitch's terms or any applicable law; or (c) content you cause to be transmitted through the service.
13. Termination
We may suspend or terminate your access to the service at any time, with or without notice, for any reason — including violation of these Terms or harm to other users or the service. You may stop using the service at any time. Sections 4, 8, 10, 11, 12, 14, and 15 survive termination.
14. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts. This clause does not deprive you of any consumer-protection rights that apply mandatorily where you live.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be announced in the extension's release notes. Continued use of the service after a change means you accept the updated Terms. If you do not agree to the updated Terms, stop using the service.
